Studies On The Circulation Of Farmland Contract Right Of Suzhou

《Rural Land Contract Law of the People’s Republic of China》 passed through Ninth National People’s Congress Standing Committee Twenty-ninth Conference, in August 29, 2002, defined that land contract rights obtained through household contract can be adopted lawfully subcontract, lease, exchange, transfer or other means of circulation, so rights of land contract and management have the legal ground. Thereafter, the central and local governments successively promulgated a series of new deals to encourage and activate the transfer of land contract and management rights, circulation of farmland contract right was lifted to a new historical height. During the "12th Five-Year Plan" period, new style agriculture modernization will be developed energetically in our country, and new agriculture system with intensive management, scientific and technological innovation will be set up. The foundation and precondition of new style agriculture modernization is the circulation of rural land contract and the increase of farmland size. Based on those, the correlation of the new style agriculture modernization and the circulation of rural land in SuZhou city were investigated to provide the basis for implementing the strategy of new style agriculture modernization at developed area in our country.In this article, the basis and the precondition of large scale circulation of farmland were explored firstly from the perspective of the economic development stage and land function, the basis and the precondition of large scale circulation of farmland was the developed economy, and SuZhou, the city with developed economy, has the macro conditions for large scale circulation of farmland. Secondly, the present situation of the farmland circulation in SuZhou and the problems during the circulation were analyzed mostly through the practical investigation, and results showed that the land circulation of SuZhou City exhibits the properties of small scale and mainly administrative push, the mainstream of land circulation of contract and management is creditor’s right, the time of land circulation is rather short, circulation scale and circulation pattern do not match the regional agricultural modernization. Lastly, the roles of land circulation in the process of agricultural modernization of SuZhou area were analyzed from the dimensions of land circulation scale and land circulation pattern, and the factors influencing the land circulation of farmer was analyzed from economic and sociological point. The establishment conditions, effects, operational mechanism, interior management mechanisms, and potential risks of land stock cooperatives were dissected thoroughly, and the corresponding suggestions were put forward, through the case of ShangLin land stock cooperative of SuZhou which acquired the business registration first in JiangSu Province.
