The Dilemma And Breakthrough Of Rural Homestead Circulation From The Perspective Of Registration

Nowadays,with China's social and economic structure undergoing profound changes,rural residents are increasingly eager to use the property attribute of rural house sites and gain an interest in the scarce construction land market.However,homestead circulation is still constrained and laws and regulations on homestead have friction with the actual demand,showing that China's homestead circulation system has been seriously lagging behind and urgently needs to be reformed.In recent years,the government has also realized the necessity and urgency of rural homestead reform.In 2015,the Standing Committee of the National People's Congress authorized 33 counties to advance the reform of "three lands";in 2017,in the Nineteenth National Report,"Deepening the rural land System Reform" was included in the important work of the whole Party and Ministry of Land and Resources decided to expand the pilot sites for rural homestead reform to 33 regions.In the year of 2018,the Central Document No.1 included "distribution of the three powers" of rural homestead and appropriate release of homestead usage rights.Therefore,homestead circulation will be the future trend.According to the research on homestead circulation,we can see that homestead circulation must be established on the basis of homestead property rights and property rights protection.Therefore,this paper chooses to study homestead circulation under the perspective of registration.In order to study this statement,this article first summarizes and analyzes the study of domestic and foreign homestead circulation and makes comments after research and comparison.And then the author makes a summary of relevant concepts of homestead circulation.After that,the author detailedly analyzes homestead,land right registration,the existing homestead circulation types in Fuyang District Hangzhou City with the help of data collection,cases study,dada analysis and established research methods and found the dilemma of the current homestead circulation in Fuyang Distric and finally find the breakthrough to the homestead circulation in Fuyang District.Therefore this has led to three conclusions:Firstly,homestead circulation should be based on the fact that land ownership does not change and the will of rural residents is fully respected.Secondly,homestead circulation and land right registration are mutually reinforcing.The transfer of homestead must be established on the premise of registration of rights.And only clear property rights and policy guarantees can make rural homestead circulation go smoothly.Once rural residents have obtained legitimate income from homestead circulation,residents will be pushed to strengthen their awareness of lawful approval,construction according to law,and land rights in accordance with law.Thirdly,transfer of rural housing sites requires the establishment of an orderly homestead circulation market,improvement of distribution mechanisms,creating a good atomosphere of benefits for rural residents,urban residents,enterprises and the government.In this way,it is bound to promote the reform of the household registration system and the improvement of the homestead circulation system.
