China and the U.S. as the fastest growing economy of the developing countries and the most powerful developed country,they have become the main driving forces of the world economic growth.The trade relation between China and the U.S. is very important.This is not only to themselves but also to the whole world.By the end of 2014,China has become the second largest trading partner,the third largest export market and the largest source of import of the U.S..However, it is because the frequent trade that the Sino-US trade friction is gradually increasing.The trade protectionism of U.S. is growing up,in addition to traditional trade barriers,new trade barrier “337 investigation” is gradually rising.“337 investigation” is the trade protection instrument in the field of intellectual property of the U.S., and it has the harsh trade remedy measures.Once the company loses the lawsuit,it will face the risk that being excluded from the U.S. market permanently.In order to maintain their market shares and economic interests, the U.S. companies often use“337 investigation” to combat and suppress competitors to the bottom of the value chain.Under the new situation,how to cope the “337 investigation” and safeguard the interests of ourselves are the key problems to the enterprises of China.This dissertation will analysis the current situation of China and the reason why we suffered from “ 337investigation”.And the dissertation will put forward China’s countermeasures.The dissertation is divided into six chapters.The first chapter describes the background and significance of the study, at the same time in accordance with the domestic literature and foreign literature,it classifies and summarizes the previous studies. And it describes the research methods and innovations of the dissertation.The second chapter compares the “337investigation” with traditional Sino-US trade barrier such as anti-dumping.Thus concludes that "337" of the "new" Sino-US trade barriers, not only "new" in the U.S. began to implement a wide range of trade barriers that late, but compared with the previous Sino-US trade barriers, it means having tough and novel features of the measures and other serious consequences.The third chapter analyses the current situation of China from quantity,product structure,complaints three aspects and the reason why we suffered from “337investigation” from the macro perspective and two countries’ perspective.The fourth chapter uses case analysis method to analysis the cases of Huawei Technologies Co.,Ltd.and Jiangsu Sinorgchem Technologies Co.,Ltd. of China,and summarizes the relevant experiences.The fifth chapter puts forward China’s countermeasures on the basis of the experiences of Japan,according to the government,industry associations,enterprises ideas to analysis and summary.Because of suffering “337 investigation” is very similar to Japan,this dissertation will put forward our response to “337 investigation” specific strategies,focusing to learn from Japanese successful experience,learning from Japanese companies from defense to initiative,and gradually mastering the world intellectual property initiative in the U.S. “337 investigation” before,changing from passive“respondent” to active “applicant”.The last chapter summarizes the certainty to become the trade power of China as long as we try our best to cope the problems.The dissertation uses the economic perspective to summarize the current situation of China and the reason why we suffered from “337 investigation”. And it uses the official figures and the typical cases to analysis the “337 investigation”. And in order to put forward China’s countermeasures, the paper analysis the enterprises behavior choice by game theory.
