China started to implement land use control system from 1998. More than 10 years of legal practice has proved that the control system plays a facilitating role in land conservation and community development. But currently there’s still a lot of illegal use of land, which we need to reflect on in time, and find out a more rigorous approach to profound research on land use regulation, to identify problems and find appropriate solutions for improving efficiency of the land resources protection and the utilization under the economic operation mechanism with increasingly diversified stakeholders.Based on the Institutional economics theory, This paper takes the development of our land use control system and its present situation of implementation as the research object, Analyzes the current problems existing in the implementation. Analysis showed that, the fuzzy defined land property right existing in the land use control system twisted the land property trading cost; the unstuck delegate-agent mechanism led to the unclear setting of power and responsibilities; factor of system reliance restricted the reasonable change of the system itself.Based on the analysis of the problems above, after comparing the implementation experiences of land use control system in the developed region, the author puts forward some feasible optimization advice on how to improve the system of current land use control in our country.The first is to establish stable rural collective land property rights system. The second is to perfect the delegate-agent mechanism. The third is to reduce the transaction cost during the changing of system. The forth is to improve the legal system settings, strict land control law enforcement.
