Research On Protecting The Rights Of Landless Farmers Besed On All Relevant Stakeholders Game In Land Circulation

With the urbanization accelerating in China, the healthy functioning of the land is a necessary condition,it is to meet the demand for the development of Urban-Rural Land Use, for co-ordination of industrialization and urbanization. Our Rural Land began in the Early 1980 s, developed in the coast. Since the Third Plenary Session of the 18 th Central Committee,China clearly pointed out the need to speed up the process of urbanization construction, optimization of land resource allocation purposes.Although China already has decades of experience in land transfer, there have been many problems in the actual transfer process, it is the rights and interests of farmers have been infringed unknowingly, with the urbanization accelerating and labour forcen transferring to the second and the third industry. The gradually accumulated damage, when it generated in the process of Land Circulation, will slow down the process of our economic and urbanization, even destroy a society to stabilize. In the land transfer, the relevant stakeholders who take part in land circulation, apart from the land transferee and the land transfer party, there is grass-roots government, central government, intermediary organizations, farmers relatives and other stakeholders. In this thesis, we only play an important role in the removal of land transfer in the four core stakeholders, namely farmers, land transferee, grass-roots government and the central government. On the overview of the domestic and foreign land ownership and land transfer on protection measures in the interests of farmers, using game theory and rent under asymmetric information on the core interests of the stakeholders involved in the land transfer game analysis, identify other stakeholders select certain probability and game process will lead to damage to the interests of farmers on strategies and identify strategies to maximize the interests of both sides in the course of the game.In the analysis we found that farmers in the land transfer process is one of the basic information disadvantage, and because of their environment and their status limits for itself owned interests in land transfer and how to protect their own rights and interests are often in a weak side. By analyzing the results there are four main causes of damage to farmers in land transfer rights, the first is due to grass-roots government in their own interests often choose negative implement the central government policy or by other means to hedge the policy, leading farmers damage to the interests; the second reason is because of land contract and management rights are derived from other rights for agricultural land is not clearly defined and explained to the farmers; third is due to the inconsistent flow of information channels, resulting in most cases farmers under for the underdog to information, in the course of the game easily lead to the interests of the occupation; the fourth is due to land in the transferee to maximize their own interests to consider tend to consider and grass-roots government rent-seeking, harm the interests of farmers. Game based on analyzes and summarizes opinions, targeted put forward countermeasures and suggestions, as well as hope for the healthy functioning of Urbanization in China’s land to make a contribution.
