Research On The Protection Of Farmers’ Rights And Interests In The Process Of Rural Land Circulation

With the advance of China’s modernization, urban and rural showing rapid development momentum, the scale of rural land circulation continues to expand. In the rural areas, land carrying heavy responsibility to protect the life of farmers and the development of agricultural production responsibility, land revenue is an important source of farmers’ income, how to protect the interests of farmers in the rural land transfer process, not only related to the overall development of agriculture, farmers, rural areas, but also related to the construction of harmonious society and the realization of the great goal of building a well-off society in an all-round way.The paper was based upon the Marx’s basic theory, taking the practice of Chinese rural land reform as the background since the beginning of the opening up policy, starting off the relationship between flow and protect the rights and interests of farmers, First of all, the concept of the land transfer, the rights and interests of farmers were scientifically defined, the related rights were produced in the land transfer and the inevitability of land transfer were explained; Then, it analyzes the present situation of the damage to farmers’ rights and interests in four aspects that including the income of the farmers’ land transfer is damaged, the rights of the land are damaged, the loss of basic livelihood security and the employment rights are damaged; On the basis, taking scientific outlook on development as a guide, adhering to the people-oriented, focusing on how to protect the rights and interests of farmers, targeting put forward countermeasures to protect the interests of farmers in four aspects that including improving the land transfer system, fostering rural land agency, clearing government functions and improving farmers’ employability, to construct the countermeasure system of protecting the farmer’s rights and interests in the circulation of rural land, thus promoting the development of modern agriculture and the process of building a moderately prosperous society.
