Research On The Security Of Farmers’ Rights And Interests In The Circulation Of Right Of Land Contractual Management

With the deepening of reform and opening, China’s rural social and economic structures have undergone major changes. A large number of people are migrating from area rural to urban, accompanying fewer and fewer young people engage in agricultural production. At the same time, the degree of mechanization in agricultural production is also increasing. Modern agriculture, which is large-scale, centralized and specialized, is being popularized in rural area. All of these make the development of the circulation of the right of land contractual management possible, and with the encouragement of the national policy, it has been rapidly developed. However, although the development of the circulation of the right of land contractual management is prosperous, it still has many problems, such as encroaching farmers’rights and interests, which will not only affect the healthy development of the market economy seriously, but also harm social justice and stability. So, it has a significant influence to secure farmers’rights and interests in the circulation of the right of land contractual management.In the first chapter, the author describes the overall situation of the circulation of the right of land contractual management. Firstly, this chapter reviews the reform of land circulation system since the founding of People’s Republic of China. Secondly, the author analyzes the overall development situation, the development characteristic, and the mode of the circulation of the right of land contractual management.In the second chapter, the author summarizes the problems of the security of farmers’ rights and interests in the circulation of the right of land contractual management by different aspects, such as circulation process and income,source of farmers’life and protection of arable land. In the third chapter, the author explains the reasons of these problems by different perspectives, such as legislation, government, farmer and market. Every perspective also has many different reasons, so it is impossible to solve the problems in a short time.In the fourth chapter, the author raises many recommendations about how to enhance the security of farmers’ rights and interests in the circulation of the right of land contractual management, such as protection of land resources, farmers’ life after circulation, farmers’ circulation income, and improvement of market mechanism. The security of farmers’ rights and interests in the circulation of right of land contractual management involves different aspects, so it needs each participant to work and act together to solve existing problems.
