The Contracting Management Right Transfer Under Farmland Property System Changes

As the source of social wealth, land is not only the foundation of rural economic development, but also the foundation of the whole economic and social development. As a post that modernity and production data is required for the completion of the industrialized countries, countries through urban and rural segmentation "binary" economic system, of rural production and living of comprehensive control, the state from the rural areas get a large number of production and means of subsistence, China quickly realized the industrialization. However, the performance of rural land property right system in the period of people’s commune period has a high concentration, which is a great obstacle to the development of agricultural productivity in the later period. After the reform and opening up, the household contract responsibility system is implemented, which makes the rural land ownership and the right of contracting out, activate the rural economy, and promote the development of agricultural production. But at present, our country has entered the industry nurturing agriculture and agricultural modernization development strategy transformation. A large number of rural labor into cities, abandoned land, land fragmentation status difficult to form the scale of operation, the transfer of land realize scale management as the core to solve the problems in the development of agriculture in China. Under the new situation, it is necessary to reform the land property right system and adapt to the current situation of land circulation. According to the actual situation of the rural areas, the central government made clear that the arrangement of the right to land ownership, the right to contract and the right to operate the "three rights", played a certain role in promoting the circulation of agricultural land property rights. The farmland property right system is the foundation of the farmland circulation, and the circulation of the rural land has an important influence on the reform of the rural land property right system. In order to solve the problems in the circulation of agricultural land management right, we must make a thorough and systematic analysis from the perspective of the reform of rural land property right system, so as to put forward some pertinent suggestions.The change of agricultural land property rights system of rural land contractual management right of object, combined with the new institutional economics and Marxist theory of land property rights of China’s rural land system reform history carried out and grasp the law of change of agricultural land property rights system. On the basis of this, the relationship between the land property right system and the rural land contract management is analyzed deeply and systematically. At the same time, the paper explains the reasons of the problems in the circulation of agricultural land contractual management right in China, and puts forward the way to promote the circulation of agricultural land contract management right in the light of these problems.This article is divided into five parts. The introduction part describes the study on the reason and significance of the research, analysis of the theoretical and practical significance of the articles related to the contents of, especially to domestic and international research in this field to analyze the situation. Thus we can use appropriate methods for the creation of the article, such as literature research method and system analysis method, comparative analysis method. In the second part, through the related theory of land property rights and the historical changes of China’s rural land system to analyze the relevant issues. The third part from the agricultural land property rights system reform the necessity and suggestions to improve the farmland property right system of land circulation of the role in promoting aspects of research, and to explore the relationship between the change of agricultural land property rights system and land transfer. The fourth part points out the problems and causes of land circulation in the current stage of China’s agricultural land property rights system, in order to seek solutions to ensure the normal circulation of agricultural land at this stage. The fifth part is about how to perfect the system of agricultural land property rights, promote the land circulation and put forward the countermeasures and suggestions. Through solving the problem of land circulation in the change of farmland property right system, the problem of land circulation in our country is further understood, which provides a reference for the better land circulation and revitalize the rural economy.
