The vast land of our country contains a large number of reserves of mineral resources,forming a large and complete categories of mineral mining,and a number of resource reserves locating in the forefront of the world.Mineral resources have an important position,playing an supporting role in the economic development,and promote the development and progress of Chinese society.With the development and utilization of mineral resources,people exploit the mineral resources excessively in order to develop the economy,ignoring the protection of the environment,and the negative impacts appear increasingly what resulting many environmental problems,restricting the further development of economy gradually,affecting environmental security.Therefore,it is imperative to carry out the active mine environmental governance.The existing laws and regulations of the legal system of mining environmental governance can not solve the environmental problems in the process of resource exploitation and utilization perfectly.Completing the legal system of mine environmental governance would be a inevitable requirement,it help standardizing the mine environmental governance behavior,and providing the legal basis and theoretical support for the implementation of mine environmental governance in China.Around the theme of the mine environmental management system,the first part of the paper is the introduction,it introduces the research significance and the present situation of the legal system of mine environmental governance.Through the scientific research methods,the paper puts forward some innovative points such as a strict mining access system,completing the deposit system and establishing the tracing and evaluation system.The second part is the overview of mine environmental management,it introduces the concept of mine environmental governance and the legal basis in China,in addition,the development process and characteristics of the existing mine environmental governance system in our country are introduced.The third part is a comprehensive analysis of the problems of the existing mine environmental governance legal system.The legal system of the mine environmental governance is not perfect.It has not yet promulgated special regulations;the mining access which the threshold stays low;third-party governance system of mine environmental governance has not yet been established;the standard of the mine governance restoration depoit syetem keeps low,and the requirements of returnningphased is fuzzy;post-event tracking and evaluation system is not established,supervision and inspection system is not perfect and so on.The fourth part is the necessity of perfecting the legal system of mine environmental governance.The fifth part is the introduction of the foreign advanced mine governance system,whose sestem is more representative are selected.Furthermore,the laws and regulations are introduced.In the sixth part,on the basis of the third part,the paper puts forward some suggestions on how to improve the legal system of mine environmental governance in our country by referring to the foreign advanced system: establishing the special regulations of mine environmental governance and strengthening the interface with the relevant system;performing the stricted mining access system;introducing the third-party governance mechanism,and implementing the third-party governance system;improving the mine governance restoration depoit syetem and the level of government indemnification.establishing the post-event tracking and evaluation system,and perfecting supervision after the governance;improving the government's supervision system.Perfecting the legal system of mine environmental governance will effectively protect the mine environment,in order to realize the sustainable development of society.
