Planning Environmental Impact Assessment(hereinafter referred to as the Planning EIA),from decision-making important gripper source protection of ecology and pollution control,is to optimize the economic development,promote social harmony and progress,an important means of building ecological civilization.Planning EIA system in China from scratch,from paper to practice has experienced a long development course.To study the improvement of the system of Planning EIA,the first thing to continuously explore achievements over the years for certain,lessons learned,accumulate experience.Next to see the Planning EIA system in China still has a lot of shortcomings,while the institutional framework has been established,but the lack of detailed implementing rules lead to the existing Planning EIA system of practical guiding significance is not obvious.Finally,analyze the current Planning EIA system in China,and find out the deficiencies,and make up for the defects is suggested,in order to Planning EIA can realize the source control,promote the scientific decision.As a result of poor Planning EIA in our country development foundation,late start,slow development,there are still many problems in the two aspects of legislation and law enforcement.In the aspect of legislation,mainly the following deficiencies:Planning EIA in a narrow scope and vague;Planning EIA procedures in the various departments responsibility is not clear;The relevant departments of the operation is not standard,public participation system and safeguard mechanism is not sound;The provisions of the lack of alternative.In terms of law enforcement,mainly exist the following problems: planning,examination and approval department of Planning EIA legal consciousness,law enforcement way is not standard;Planning EIA technical method is not mature enough;The lack of high quality Planning EIA.Therefore,have to be perfect for Planning EIA system in China,legislation should be: specify the specific scope of the Planning EIA.Reform and perfect the existing planning operation process;To strengthen the public participation,and improve the guarantee mechanism;Increase the provisions of the alternatives.Law enforcement should be: improving Planning EIA legal consciousness,the transformation of the mode of law enforcement;Advance Planning EIA technical system construction;Cultivate talented of Planning EIA.Only from two aspects of legislation and law enforcement,make up for the deficiency of Planning EIA in our country,both,to avoid Planning EIA become a mere formality,advance Planning EIA work effectively,realize sustainable development.
