| Our country has been plagued by smog and haze pollution since 2010,therefore,The Standing Committee of the National People’s Congress revised the laws and regulations to protect the environment,and government departments also initiative to co-ordinate the planning according to the relevant laws and regulations and take a series of measures to control air pollution from top to bottom.From a national point of view,the smog and haze pollution in Jinan has a certain degree of typicality.It is the reason why I choose this city as a research.I hope this text will offer some suggestion of legal governance in the haze pollution not only in Jinan,but also in other cities.This paper is divided into seven parts:The first part is introduction.It mainly introduces the purpose and significance of this topic,the current situation and development trend of the research at home and abroad,the main research content and innovation.The second part is the basic situations and harm of haze pollution in Jinan.The relevant data which originates in the Ministry of Environmental Protection and the Office of Environmental Protection of Shandong Province analyze the air quality and haze weather conditions since the beginning of 2010,especially in 2014 and 2015 in Jinan.It also expounds that the haze pollution has bad effects on our health as well as the huge economic losses for production.The third part is the cause of haze pollution in Jinan.It mainly divided into natural factors and social factors.Natural factors mainly refers to the abnormal meteorological condition and unfavorable terrain conditions.Social factors chiefly includes local factor such as coal combustion,dust and industrial production,vehicle emissions and others.Meanwhile regional transmission increasing this possibility.The fourth part is the present situation and evaluation of the legal governance of haze pollution in Jinan.This part mainly introduce the local legislation of the prevention and control of atmospheric pollution in Shandong province and Jinan City based on environmental protection law and air pollution prevention law.I also focus on the atmospheric environmental standards and the elimination of the transformation of coal-fired boilers and the relocation of the eastern old industrial area.At the same time,this part mentions some measures include that developing public transportation systems and provincial city group joint prevention of air pollution.The end evaluate the current management situation,find out the deficiencies.The fifth part is the experience of urban air pollution control.This part draws some worthy experiences after the Photochemical smog event in Los Angeles and the fog disaster.Because most cities in China including Jinan are likely to be in a serious pollution situation just like Los Angeles and London.It depends on each city how implements in spite of there are plenty of national laws.In addition,we need to learn from some measures of preventing air pollution in other foreign cities,such as Mexico City,St Paul,Tokyo,Paris and other cities in Germany.The sixth part is the measures to deal with haze pollution in Jinan.It is mainly based on the current situation and the cause of formation,and take overseas theory as a lesson,I put forward some advice to tackle smog and haze pollution inside the "City District Governance”,Intercity interconnection and strengthening environmental protection obligations both enterprise and citizens.This theory is based on the common but differentiated responsibility principle,the principle of environmental cooperation and reasonable burden of pollution damage liability principle,principle of unity of rights and obligations.The seventh part is the conclusion. |
