The Study On Legal Problems Of Soil Environmental Monitoring In China

With the rapid development of economy in our country,the pollution and damage of soil environment are becoming more and more serious.Prior to the deterioration of the soil environment,measures must be taken to stop the current situation and to maintain the health of the soil environment.Soil environmental monitoring has the characteristics of continuity,long-term.Comparing to other types,long-term soil environment monitoring,routine monitoring,environmental monitoring not only is more necessary and more difficult,there are higher requirements for the mechanism of soil environmental monitoring.In the world,since 1950s to nearly 70 years,the evolution from soil environmental monitoring of sudden pollution accident investigation and monitoring to soil environmental quality monitoring,with the legislation embodied by "terminal of governance" to the idea of "prevention first"principle.China's soil environment monitoring legislation have been passed legislation blank period before 1973,and principled legislation of the period in 1973-1989,then to the fuzzy legislative period in 1989-2014,and finally to make special legislation in 2014.The whole period showing the scratch from vague to clear,from principles to specific.At present,China's soil environmental monitoring legal system is not perfect,the monitoring object is not perfect,including agricultural land and construction land.To solve those problem,the legislation should establish the priority of farmland and centralized drinking water source;With the rapid development of technology of soil environmental monitoring,soil environmental monitoring and analysis method is not coordinate with the relative lag,so the operation basis is not enough and not regulated,so soil environmental monitoring analysis method should be specific and standardized,and through the improvement of the quality standard of soil environment,there will be effective guidance for the monitoring and analysis methods,these measures can effectively improve the standard of soil environmental monitoring analysis method legal system;To improve the mechanism of soil environmental monitoring,we should fulfill public affairs set and define the boundary of the scope of service provided by the third party social monitoring institution,and further improve the standardized management of the third party's social environment monitoring institutions.
