Justice has always been one of the objects of the study of political philosophy and ethics.Rawls' theory of justice is a great theory of justice,but it still can not solve all social problems.Martha C.Nussbaum,a contemporary American ethician who,as a member of virtue ethics and also a representative of the neo-Aristotelian,places a high priority on social justice,and pays close attention to ingrained social injustices and inequalities.Also she conducts in-depth studies on how to solve social reality issues,and devotes herself to developing the theory of capabilities theory of justice.The essay mainly discusses the origin,basic ideas,solutions to social problems and so on of Martha Nussbaum's capability theory of justice based on the books Frontiers of Justice and Creating Capability.Finally I evaluate her theory.The essay first examines Nussbaum's critique of utilitarianism and Rawls's theory of justice.She criticized the utilitarian model for measuring social development and considered that it is unreasonable to regard economic development as the sole criterion for measuring the level of social development.Apart from the economy,social development has many other important contents,such as education,environment,and medical and health.At the same level,wealth and income cannot be the sole criterion for measuring human development.In this regard,she proposed the concept of poetic justice and advocated the use of emotional power to arouse people's attention to individual life.However,she realized that poetic justice cannot substitute for utilitarianism and can only serve as a supplement,and then put forward the theory of the justice of capabilities.Then the essay' traces the ideological origin of Nussbaum's capabilities justice theory.The theory of competence justice is rich in sources and influenced by many people's theories.It is deeply influenced by Rawls and Amartya Sen's theory of justice.After that the article reviews the basic content of capabilities justice,including the background,connotation,capabilities list,verification and implementation.Nussbaum found that Rawls's theory of justice is the most powerful justice theory through his examination of the theory of justice,but his theory is still unable to provide reasonable theoretical support in the face of several difficult problems facing the society.Afterwards,the article explores how Nussbaum builds capabilities justice based on Sen's theory and applies it to real-world problems:disability rights,global justice,and animal rights,and is committed to proposing reasonable solutions.Through sorting out Nussbaum's content of justice theory,it is pointed out that capabilities justice not only reflects on the previous justice theory,but also corrects and supplements it,and provides a new paradigm for the formulation of human development policy.Through the study of Nussbaum,it not only increases our understanding of justice theory,but also provides theoretical guidance for solving many injustice issues of the contemporary era,and provides a framework for policy formulation,providing new ideas for the realization of social justice.However,her theory relies on intuition and has defects in the definition of capabilities.In the course of practice,she also encounters many difficulties.
