Research On Micro-blog Copyright

Micro-blog is developing rapidly in China and it is constantly changing our life. Meanwhile, micro-blog also causes some unavoidable problems. The main reason is due to micro-blog’s own characteristics, such as weak legal consciousness of some bloggers,advanced network technology and various seductions. As the number of users increasing year by year, infringement of micro-blog copyright is becoming more and more serious. It not only violates the benefits of the people owning the copyright, but also disrupts the network platform order. How to strengthen the protection of micro-blog copyright has become a prominent problem. Many academics pursued research one after one. This paper has a preliminary study on infringement of micro-blog copyright, and is to propose some possibly effective detailed steps for strengthening protection of micro-blog copyright through analyzing how to identify the action of infringement of micro-blog copyright, exceptive rules of infringement, and the types, features and reasons of infringement. The main ways are as follows: strengthen the network operators in the industry management; perfect the laws and regulations; improve the user’s awareness of the law; strengthen the administrative remedy; reform the existing network technology etc.Finally, this paper introduces the protection and its duration after the copyright owner dies, and the reality that protect the micro-blog copyright by succession. Through the research on the above problems about micro-blog copyright, this paper is to seek certain solutions to the infringement of micro-blog copyright, and reduce the phenomenon of infringement, standardize the order of internet market, ensure the healthy and orderly development of micro-blog, and make it better perform its communication function.
