The Problems And Countermeasures Of The System Ofcommunity Correction In China

Community correction, has the decades or even centuries of history in some western countries, and gradually become a fixed implementation of the system. However, in our country, it is still in the nascent stages, it mainly refers to the effective use of all aspects of the social forces and all kinds of social resources, educational and management penalty punishment lighter, smaller social harm offenders correct their criminal psychology and criminal behavior, enabling them to return as soon as possible to the implementation of activities of a non-custodial penalty punishment society.Since the community correction system implemented in China, it has made a very significant achievement in reforming the penal system, and building a harmonious society etc, it also explain that the community correction system conforms to Chinese national conditions and has very impressively social value and social benefits. But the time of its establishment is shorter, there are some problems such as no performance standards, and it couldn't get the support and understanding from the people. Therefore, China is still facing many problems which need to be improved and perfected, will enable community correction system gradually from an obscure state to be a clear state.The paper is based on this purpose, mainly uses the method of comparison research and the survey procedure, and focus on the comparative analysis of the domestic and international community correction system and the minors community correction system to explore. Through five major parts to elaborate the community correction: the first part is the research background, object and the research present situation, significance; the second part is the overview of community corrections, and divided into two sections--One section is the concept, characteristics and type. Another section is the nature, principle and function; the third part is the historical process and comparison of the community correction system in China and western countries; the fourth part is the problems of the community correction system in the implementation process;the fifth part is the reformation and improvement of the control, probation and minors correction.
