Study On The Mechanism Of The Reform Of Chinese Prison Inmates

Although we live in a developing civilization,it is still hard for the whole world to prevent criminals from committing further crimes effectively.People deeply believe that what can reform criminals effectively so that criminals who are released,released on parole and temporarily executed outside prison can get back to a normal life and lower their possibility of commiting further crimes is prison.It also means great to Chinese prisons to punish and reform criminals effectly.In December 29,1994,at the meeting of the eighth of Standing Committee of the National People's Congress,Prison Law of People's Republic of China is passed through which opens a new gate to Chinese prisons.As is set up at the first rule of Prison Law:According to the Constitution,to carry out criminal penalties correctly,punish and reform criminals,prevent and decrease crimes,the Prison Law is formulated.We have to know that prison is a place where not only punish the prisoners but also reform the prisoners and provides a reborn chance for those who are released on parole.But we Chinese prisons are still in the initial stage of social development,legal system develops fall behind from social development,education can't keep pace with social and cultural's development,optimal allocation of funds can't adjust well with the change of social economy and so on.There are two points should Chinese prisons focus on,one is the construction of all kinds of prison systems,the other is the execution of criminal penalties.Considering the complexity of committing further crimes,one thing we should always keep in mind is that there is no inherent relation between the occurrence of committing further crimes and the tightness of prison,perfection of prison systems and so on.Therefore,I try to achieve a reform system which benefits Chinese prison's development and shows equality to prisoners and keep prisoners up with society during prison time by fining out the defects of Chinese prison system in reform prisoners,considering the traits of Chinese judicature,curltural,social,and thingking about the meaning of Chinese prison's existence and the value orientation of criminal penalties' s execution.
