The Research Of Legal Mechanism Of Compensation To The Forest Ecological Benefit In Our Country

The forest not only has economic value, but also has ecological and social value. But the eco-production of forest belongs to the typical public product, and the ecological value is difficult to be realized through the market exchange. Therefore, it is important way to realize the ecological value of the forest to establish the legal mechanism of compensation to the forest ecological benefit. The rev vision of the Forest-law stipulated that, the fund of compensation to the forest ecologic benefit, which is established by the state, is used in forest construction, forest nurturance, forest protection and forest management. Although these policies and regulations played an important role in forest protection, they still have some urgent problems to be resolved. For this reason, this article analyzed the legal mechanism of compensation in our country, and propounded the perfect measures to provide the system of the legal protection for the forest.This article consisted of four parts: the first part introduced the concept of compensation of the forest ecological benefit, and then presented the economic theory about compensation of the forest ecologic benefit, such as the principle of public production, the theory of environment value, the theory of forestland and so on; the second part researched the necessity of the legal mechanism of compensation to the forest ecological benefit, and proposed the legal rationales of the legal mechanism of compensation to the forest ecological benefit; the third part analyzed the existing legal institution ,and propounded some present problems about the legislation and the supervision; the last part proposed the perfect measures to resolve those problems which were put forward in the third part.
