Research On The Legal Protection Of Financial Consumers' Right To Know

In recent years, the continuous development of social economy have made the financial consumption has become a part of everyday life of ordinary people, protect the consumer rights problem also became a hot issue in academic circle s. However, the protection of financial consumer rights is different from the general consumer rights protection, financial consumers is to financial commodity as the object, they often deal with financial institutions under the condition of serious asymm etric information, so the system of financial consumer rights protection has its particularity, for the average consumer rights protection concept cannot cover. Right to know is the basis of the financial system of consumer rights, Only the right to protection, can talk about other rights protection. T herefore, this paper aimed to study financial related issues of legal protection of consumers' right to know, in addition to the introduction and conclusion, the full text consists of five parts.The first pa rt is a summary of the financial consumers' right to know. Due to the financial consumers in our country is not a legal concept, therefore the premise of financial consumers' right to know is that we must define financial consumer, the definition is based on the foreign and domestic circles to the definition of financial consumer to summarize, again on this foundation, I will state the definition of consumers' right to know and its structural characteristics, connotation and scope.The second part is the legitimacy basis of consumer right to know. T his part based on the foundation of law, sociology and economics basis three different areas to show that it is necessary to carry out protection of financial consumers' right to know.The third part is the extraterritorial countries of financial consumer right protection. T his part according to the different types of regulation by enumerating typical countries to state how the countries outside to protect the financial consumers' right to know.The forth part is the present problems of financial consumer protection. This part analyzes the problems of the protection of financial consumers ' right to know in our country from four aspects:legislation,supervision,right relief and the consiousness of financial consumer r ights protection.The fifth part is the legal protection mechanism of financial consumers' right to know, which is divided into four pieces, the first part is to protect the financial legislation. T he second part is to improve financial supervision. T he third part is to perfect right relief mechanism.T he fourth part is about to strengthen financial consumers' awareness to protect their rights.
