Research On Changing Detailed Compensation Policies In The Demolition Of Jinzhou New District

Demolition compensation, as the most important problem in Urban Relocation Process, means the compensation for the people who lost their land tenure and their house property during the city demolition. Civilization and modernization are the reconstruction of the society, which can’t avoid the land demolition. Economically city demolition is a resource relocation process. The government, local government officers and the demolished households are the three players. So how can they play their roles and resolve their conflicts and problems to enjoy their own rights lawfully are the main problems in the city demolition.Our current policies of demolition compensation are originated from planned economy period. In nowadays market economy, many disadvantages have shown. So we need make new detailed policies to fulfill the existing circumstances. The standard compensation should be similar to the reasonable price in the market, and all the process should be fair, just and logical. With the improvement of the demolition compensation policies, we can not only just protect the national land resources, but also ensure the rights and benefits of many demolished households, which are the most important steps in the process of national legalization, and the important parts of social harmony.Therefore, firstly we systematically studied, investigated and compared the details and the problems of the demolition compensation in different period of our country. Then we discussed how we can improve our current policies to fulfill the fair and just compensation in the demolition, and to ensure the working efficiency and the rights of demolished households. Secondly, with specific cases report, we discussed the changing policies of demolition compensation in Jinzhou New District, and the problems that happened in urban construction. Here, we focused on the local government officers to study the problems and troubles in urban demolition and the demolition compensation. As the executors in urban demolition, the local government officers had the discretionary power which caused continuous innovation of demolition compensation. Finally, we made some comments and gave some suggestions to these questions or problems happened in the demolition compensation from three aspects, including the legalization by government, the communication of local government officers and the demolished households, and the improvement of the social supervision system. However, we need make new compensation and supervision policies which should be well-developed and long-standing rules that fit to our country, to completely solve the demolition compensation problems.
