With the deepening of reform and opening, China’s market economy develops rapidly and international cultural exchange increasingly deepening, which make China’s education system constantly improving. Currently, the system of compulsory education in our country is the nine-year compulsory education system, which means a teaching model that students are studying in junior high school for three years and primary school for six years. Thanks to the prosperity of the market economy, the primary and secondary of even the high school after-school tutorial industry continue expanding and developing. In order to achieve standardization management of the after-school tutorial industry, the government has adjusted associated normative legal documents in an administrative way. At present, there are a few laws and regulations to do with the primary and secondary school after-school tutorial industry. The regulations which made by the Ministry of Education have limited the public schools’ teachers who are paid for after-school teaching. And it also relates to the problem of the standard management of after-school educational institutions. However, rules for paid-teaching teachers who work in public school are different from provinces, autonomous regions and municipalities. Therefore, in some ways, there is a disagreement about the value orientation of local legislation.Based on the local legislation how to implement the legal value and comply with the legislation principles, this thesis deeply analyzing and summarizing the reason why it be in crisis; making comments about the development of the primary and secondary school counseling industry factors; analyzing the causes of the primary and secondary schools’ serving teachers are paid to teach after-school and the form of existing educational training institutions. Those all help to seek an outlet of the primary and secondary school after-school tutorial industry. Local legislation should specify a value orientation of legislation and follow scientific principles. Under the context of market economy, based on the foundation that we can analyze to predict the prospects of social development, local legislation should absorb foreign experience and moderately make advanced relevant legislation for the local primary and secondary school after-school tutorial industry and standardize the primary and secondary schools’ serving teachers and the management of education institutions and organizations.Until this year, the hotspot of NPC and CPPCC is still inseparable from education reform. This thesis will start with the following four aspects of the relevant local legislation on the primary and secondary school after-school tutorial industry:In the first part, analyzing the present situation of legislation. Elaborating the present national legislation of the primary and secondary school after-school tutorial industry, and then analyze the specific differences from the local legislative level and the legal status of local the primary and secondary school after-school tutorial industry.The second part is studying the dilemma place of relevant local legislation on the primary and secondary school counseling industry. Local legislation about the primary and secondary school counseling industry in our country, facing difficulties of varying legal value, including the conflict of justice value, the balance of the individual and collective interests, the value of the order weakening; local legislation how to follow scientific principles of dilemma; the necessity of harmonization of legislation.The third part is the reference to the foreign education legislation. By research of the primary and secondary school counseling industry of South Korea, Japan and the European Union, analyzing conditions and social environment which foreign education legislation is based, forming preliminary model of local legislation regulation of primary and secondary after-school tutorial industry by summarizing foreign experience.The fourth part is the way out of the local legislation on the primary and secondary school after-school tutorial industry. Firstly, the behavior of primary and secondary schools serving teachers’ paid-teaching should be legalized and accompanied by a reasonable standard; secondly, local legislation for a particular industry should focus on the effectiveness of the law, clearing the value orientation, following the scientific principles; finally the writer recommends that local legislation should have a certain predictable resistance and make a moderately advance legislation of the primary and secondary school counseling industry.
