The Expression And Practice Of Rights Of Ethnical Minorities In China

This paper is studying human rights of Ethnical Minorities. My analysis is on the basis of China's White Papers concerning Human Rights(1991--2014), and focusing on Expression and Practice of human rights of Ethnical Minorities in those white papers. I would like to discover history of human rights of Ethnical Minorities in China, hoping to find out basic expressions, contents and laws to the protection of human rights of Ethnical Minorities.This paper is divided into six parts.In Introduction, I mention the significance of this research in studying Expression and Practice of human rights of Ethnical Minorities, and introduce human rights of Ethnical Minorities is a vital part to the China's Human Rights System.Part I analyze the characters of human rights of Ethnical Minorities. In fact, languages,regions, economics, cultures and psychological factors can all be reasons to differ one ethnical group from another. Part II bring a new theory on protect human rights of Ethnical Minorities, which I named it the Three Levels on Protect human rights of Ethnical Minorities.The first level is Equal Protection without difference which based on equality principle. The second level is Special Protection, and last level is affirmed Preferential Treatment. Part III explores the expressions in China's White Papers concerning Human Rights. Part IV attempts to find out patterns and attributes in developing human rights of Ethnical Minorities. In a time dimension, basically, we can find out the great achievements in constructing the system of protecting human rights of Ethnical Minorities. The basic approach which China's government undertake is aiding the regions where Ethnical Minorities live. Obviously, Aids is the core of policy and policy is the main way in promoting Ethnical Minorities' economical rights.In conclusion, we should keep three basic goals of protecting human rights of Ethnical Minorities. Firstly, special protection and affirmed Preferential Treatment of human rights of Ethnical Minorities are much important to human rights protection, and the two approaches are arising from traits of Ethnical Minorities which we should realize and would respect.Secondly, all ways of protecting human rights of Ethnical Minorities should on the course of Rule of Law. Lastly, building up China's own discourse as to human rights of Ethnical Minorities might be a main goal of China's construction of system of human rights.
