Study On The International Legal System Of Safe Nuclear Operation

Today's international society is faced with quite severe energy crisis(the depletion of fossil energy is inevitable according to the world proven reserves of energy and consumption rate) and environmental crisis. Therefore, the peaceful use of nuclear power has tremendous space of development. To improve its status in domestic energy structure, many countries are actively developing and making use of nuclear energy. Nuclear power will become one of the main paths to alleviate human energy crisis. Compared with energy such as petroleum, natural gas and coal, nuclear energy has the significant advantages of being clean, high efficiency of use, environmental friendly, its rich resources and does not emit greenhouse gases). However, it also has the disadvantages of producing high radioactive waste. Once an accident happens, it could do great harm to human life and environment, thus causing property. Therefore, to ensure the safety of nuclear power operations has become a primary subject, which must be considered in the first place. From the perspective of international law, this article is aimed to conduct serious discussion, analysis and summary of nuclear energy based on the principles of international law: the principle of nuclear sovereignty and does not harm the environment of foreign countries; the first principle of nuclear power operation safety(the principle of prevention and protection); the principle of sustainable development of nuclear energy and nuclear accident responsibility. Combining with current relevant international legal system(mainly by radioactive material management system of international law, international law system of nuclear accident, the international legal system as an example of waste cross-border transfers) international organization related situation, it is essential to clarify its advantages and disadvantages in the process of promote nuclear safety operation(the main malpractice are: the law is imperfect, weak legal norm compulsory, weak supervision and law enforcement; the irresponsibility of international atomic energy agency(IAEA) and insufficient international cooperation, etc.) and put forward the writer's own understanding and solutions. Finally, analysis and evaluation are conducted based on the status quo of the legal system for nuclear safety operation in an attempt to proposes the writer's suggestions(such as how to build a sound operating nuclear power security legal system in our country; clarify the responsibility of supervision and administration of relevant departments; improve the system of the nuclear damage compensation, and establish a system of public intervention, etc.). Set in the process of perfecting the legal system for a secure operating of nuclear power, the article is written with the aim of serving as a humble opening for public discussion.
