On The Pension Liability In View Of The Society Of Rule By Law

The problem of the old age is about the harmony between family and society. In the context of the rule of law, to clarify the pension responsibility, build a new pension mode, is an important issue of the social construction of the rule of law.First part of this article mainly introduces the current status of China's pension problem, and based on the current research situation at home and abroad about the pension problems of detailed introduction and analysis, put forward the basic idea of this writing, perspective and method, points out the rule of law society endowment the way out of the problem is that many forces involved in the pension, to build a family as the core of new pension mode.The second part mainly introduces the theory basis of this thesis, through the social right concept, historical origin, Marxist basic viewpoint about social rights, the rule of law in society in the basic content of the introduction, with countries and the relative to the social rights and protection of the rights of civil society need to state and non state actors to work together.The third chapter mainly introduces the reasons, the basic contents and the problems of the traditional social and family pension. Family bear the responsibility for the elderly, is the traditional way to support the elderly, it saves the country's pension resources, and maintain social stability, but also meet the spiritual needs of the elderly. However, in the social right of the state, the state and society should also share part of the pension responsibilities.The fourth part introduces with economic development, the history of social change and progress, in sight of the rule of law, the concept of family pension liability should be given a new connotation, pension does not depend on the family, the state and society should be fully play its pension functions. Meanwhile, details of the state,society and families of their commitment to specific pension obligations.The fifth part mainly through the analysis of overseas outstanding pension experience, from abroad to solve the same problem in the method of endowment patterns of different countries, pension system is introduced and compared, fosterstrengths and circumvent weaknesses, and combined with the actual conditions of China to draw lessons from to absorb them, and for the implementation of diversified pension in our country under the rule of law society responsibility to provide some positive suggestions.The last part based on the above chapters, detailed description of analysis, and points out that under the rule of law to crack plagued China has long been the pension problem, must suit the remedy to the case, to implement the national, social and family assume their respective specific pension obligations, and to present the reconstructed with the family as the core of the new pension model some concrete countermeasures and measures.
