A majority of the employees' sense of protecting one's legal right has finally been awakened since the issue of the law of the people's republic of china on employment contract. Under this background, the amount of labor disputes has increased rapidly since the year of 2008. This huge number of disputes cannot be sufficiently solved by existing disputes settlement systems in China. How to break through this problem is under the whole society's consideration. This thesis focuses on the settlement at the beginning of labor disputes, which means improving the mediation procedures and pinpointing the rights and obligations of leading parties at this stage in order to establish a highly efficient pre-trial settlement mechanism. Then this settlement mechanism will be helpful to protect employees' legal rights, balance the interests between employees and employers and decrease the rapid-increasing growth rate of labor disputes.Chapter 1 mainly summarizes the history and current situation of China's mediation procedures on labor. Then according to the research in district X of City S, this chapter analyzes the difficulties faced by the leading parties which are obstacles to the efficient operation of the mediation mechanism.Analyzing current social structure. Chapter 2 of this article analyzes the feature and the cause of the labor disputes, raising the following two arguments. Labor disputes are mainly caused by the interest of games between employees and employers. If the bridge of communication between employees and employers could be established, the labor disputes could be solved during the mediation procedure. Local labor unions can play the leading role in the mediation settlement mechanisms is determined by its character, function and mission. Chapter 3 raises effective suggestions of mediation settlement mechanism on labor disputes, based on the local labor union-oriented mode.
