The Legislative Research On Hungarian Diaspora Protection

The issue about Chinese diaspora, especially the protection of rights and interests of overseas Chinese in the legislative, has been a major problem in our country. China is now promoting the drafting of an "Overseas Chinese Rights and Interests Protection Law", but in the way of legislation, there are still some difficulties. In fact, many countries are suffering from the diaspora protection problems, there are many countries made the corresponding policy to deal with these problems, the author believes that the study of the protection policies of other countries is conducive to the establishment of "Overseas Chinese Rights and Interests Protection Law". Thus, the author studied the “Hungary Status Law " which was passed in June 2001, as the law protects the persons who live in the neighboring countries are non-Hungary citizens but originated from Hungary. It can provide some useful and meaningful information for us to draft the " Overseas Chinese Rights and Interests Protection Law ". In addition, the “Hungary Status Law" has caused great repercussions in neighboring countries, especially Romania and Slovakia, they have strong objections to the law, both of them think that it interfered in the internal affairs, in addition, they also agreed that some of the provisions are discriminatory. The reason why the bill has these problems is that Hungary does not adequately consider the circumstances at that time before legislating, in addition, the legislators also use vague terms in the law.Therefore, in order to avoid similar controversy before drafting "Overseas Chinese Rights and Interests Protection Law", we need to make adequate preparations, pay attention to details in the legislative process, and use the precise wording to avoid unnecessary disputes. At the same time, we can draw lessons from the overall framework of Hungary Status Law combining the actual situation of our country.
