The Perfection Of The Regulations Of The Investigation Of The Chinese Communist Party Discipline Inspection Organs

The party's Fourth Plenary Session of eighteen proposed to promote the rule of law, and the party according to law is an important part of the rule of law. According to law the advance of the party, not only makes the party's discipline inspection organs become more prominent and important, also makes the party, the party program becomes more prominent and important, makes it possible to study and improve the party tube has become a practical need. Case inspection is an important part of the discipline inspection work, and even the most important part of the work. Therefore, to research and improve management of the party and promote the standardization of discipline inspection work, the rule of law, it is necessary to study and improve the case examination method. In addition to the articles of association of the Communist Party of China, the main legal basis for the inspection of the case is the "Regulations on the inspection of the cases of the discipline inspection organs of the Communist Party of China". The regulations promulgated in 1994, has not been modified since the implementation of more than 20 years of development of the rule of law environment and handling the case, it is inevitable that there are a number of deficiencies, urgent need to improve. The author believes that is the main problem of the regulations-- the "two regulations" provisions are too simple and prolong the time limit prescribed in violation of the principle of proportionality, does not solve the discipline inspection organs and procuratorial organs of the jurisdictional disputes, made the punishment decision subject is not reasonable. This paper intends to make a detailed analysis of these issues and put forward some suggestions for improvement.According to the actual situation of the modern concept of the rule of law and discipline inspection organs handling, we should to the specific content of the form of norms and regulations of the party "two regulations", referring to the spirit of the criminal procedure law modified to extend the time limit provisions, based on the first principle of giving priority to solve the discipline inspection organs and procuratorial organs under the jurisdiction of the dispute and the punishment subject clear for discipline inspection organs at or above the county level.
