The Remedy Of Virtual Assets By The Current Legal System

The Eighth session of the Fourth Plenary Session made it clear that strengthen the field of Internet legislation, improve the network information services, regulatory network security, network management and other aspects of society is necessary. Research on virtual assets has been taken placed far more than ten years. Different ideas arosed, from the positioning of virtual assets, property, legislation and regulations, litigation to preservation measures and so on. But years of research did not bring effective relief to the virtual assets.It must be acknowledged that the ever-changing network society pushes we to protect the legal interests in a new way. Whether new interpretation of legislation, a new branch of law, administrative regulations, or in response to the Fourth Plenary Session of eighteen "to establish a diversified dispute settlement mechanism", the remedy of virtual assets by the current legal system can not be ignored.This dissertation could be divided into five chapters:Chapter 1: Reviews the plight of network assets in the course of the current relief encountered: network assets in the existing legal system, whether relief should be, how to evaluate this new network assets.Chapter 2: Analyzes the characteristics of network assets, laid the theoretical foundation for the feasibility discuss relief network assets below.Chapter 3: Analyzes the reasonableness and necessity of reliefing network assets, builds foundation of our law system to relief the network assets.Chapter 4: Describes how to break trouble of the network assets that under the existing law system,show the thinking and countermeasure corresponding to the problems.Chapter 5:Conclusion.
