The Goal Of The Rule Of Law To Promote The Judicial Credibility Path

With the deepening of China's reform and opening; the centrally emerging of social contradiction within this transition period and thus the judicial work in our country is facing severe challenges.democratic was rising up, which puts forward higher requirement to China's judicial credibility.In the new era under the new situation, high level of the judicial credibility reflected people's recognition and respect for the law, represented people's trust and affirmation to the party and the country, to strengthen the construction of judicial credibility was the basic premise to realize China's dream, and also the important foundation for constructing the honesty-credit social which led by the socialist core value system of values.However, our judicial credibility was repeatedly questioned due to the inevitable series of contradictions during transition. Society's moral declined and integrity lost, what induced many social problems which obstructed seriously sustainable and healthy development in China; hindered the orderly operation of social economy and more negative impact on people who were going through the anxiety in this transition period. Therefore, on the basis of law-oriented, we should to promote our judicial credibility further for forwarding the course of running state affairs according to law smoothly and better. This paper will be divided into four parts:The first part: summary of judicial credibility. This part sums up the relevant theories of judicial credibility, defines the concept of judicial credibility, and summarizes the basic features of judicial credibility, lists the components of judicial credibility, so as to clear the theory to the research in subsequent sections.The second part: to improve the necessity of judicial credibility and the status quo. This part expounds the necessity of improving the judicial credibility first, and on the basis of the analyses present situation of our country's judicial credibility, including a lack of respect for social members to the national judicial system, the results of the social members of the judicial process questions and unclear line between media supervision and judicial practice, the problem of judicial corruption, the judicial credibility, the credibility of the lack of the rule of law culture related contents of five aspects.The third part: the analysis of the causes of low level of judicial credibility. This part are from the perspectives of the public, justice system and justice practitioners for discussing the low level reasons, which is the direction for the following forth part. The fourth part: the suggestions and countermeasures to improve the judicial credibility. Tried to take the idea of "governing the country according to law" as the macro guidance, to strengthen the deepening of reform in judicial system, to improve the quality of the judicial practitioner, and to reshape the judicial image for rising up the judicial credibility in our country further for making efforts on healthy and sustainable development of the judicial construction according to the rule of law.
