Research On The Regulations Of Disciplinary Punishment For College Students In China

Disciplinary punishment for college students is an important basis for University management.With the strengthening of students' awareness of the rule of law,more and more cases of students suing their alma mater to court are reported.The most important reason is that students are dissatisfied with the disciplinary punishment for college students.Under the background of running a school according to law,the author aims to study the provisions of disciplinary sanctions for college students from the perspective of administrative law,and explore a way to improve the provisions of disciplinary sanctions for college students.The main body of this paper is divided into five parts:The first part: "Introduction".This part mainly focuses on the background of the provisions of disciplinary sanctions for college students in China,and explores the specific significance of studying the provisions of disciplinary sanctions for college students.At present,scholars' research status on the provisions of disciplinary sanctions for college students and the discussion on this aspect by scholars abroad.The second part:To study and analyze the current situation of the provisions on disciplinary sanctions for college students represented by ten universities.This paper makes theoretical analysis,empirical analysis and Discussion on litigation disputes caused by the provisions of disciplinary sanctions for college students.The author conducts an empirical study on the provisions of disciplinary sanctions for students in ten representative universities in China,and makes an analysis of administrative litigation disputes rooted in the provisions of disciplinary sanctions for students in universities.The third part:This paper analyses the problems in the current regulations of disciplinary sanctions for college students.Mainly from the University Students' disciplinary punishment provisions of their own problems and litigation cases reflected in the violation of the legitimacy and rationality of administrative law and other issues are discussed.Inspired by typical cases,the author makes a detailed study on the provisions of disciplinary sanctions for college students.The fourth part:A comparative analysis of the provisions on disciplinary sanctions forforeign students.The author has searched the regulations of the United Kingdom,the United States and Germany on disciplinary sanctions against University students,hoping to take this opportunity to get inspiration and absorb foreign experience.The comparative analysis can be used for reference in studying the regulations of disciplinary sanctions for college students in China.The fifth part:From a practical point of view,it provides a path to gradually regulate the provisions of disciplinary sanctions against college students,so as to fully protect the rights of students.It is mainly regulated from five aspects: standardizing the main body of rule-making,absorbing students to participate in the process of formulation,establishing the mechanism of review,supervision and evaluation,and improving and perfecting the relevant education legislation at the technical level of the rules.
