A Study On China's Legal Regulations In High-Risk Tourism

In recent years,with the sustainable economic and social development,the pace of constructing an all-round well-off society is being accelerated.In the meanwhile,the demand for tourism is getting a strong boost.Traveling has become a basic right and a popular way of life for the general public in this new normal era.In the context of a boosting tourism,high-risk tourism,for many who seek challenges and curiosity,is very attractive because of its thrilling challenges and experience.However,due to factors including human,material,environment and management,there has been a significant increase in the number of accidents in China's high-risk tourism,affecting the economic development and social stability.From the legal perspective,there are already some laws,regulations,compulsory standards and local rules,such as the Tourism Law and the Safety Production Law,regulating the high-risk tourism.Basically,we can see that the laws and regulations are being improved,the supervisory bodies are being defined and the regulatory responsibilities are being clarified.But certain issues are still containing the sound development of the high-risk tourism,such as the following seven: lack of a systematic legal system,lack of a compulsory safety standard,lack of a standardized quality management mechanism,lack of a professional safety reminder system,lack of a professional first-aid mechanism,lack of supporting insurance and guarantee mechanism and lack of a clearliability regulation.From the international practices,we can learn that the safety management of high-risk tourism mainly relies on the regulatory functions of laws and regulations,and also the managerial and control functions of the government,relevant associations and the industry.A first aid mechanism is also attached with great importance.Combing the foreign experience with the status quo of China's high-risk tourism,seven advises are raised in this paper,in order to perfect the laws and regulations,thus promoting the standardized and sound development of the high-risk tourism.Firstly,legislature of high-risk tourism must be improved.Secondly,management of high-risk tourism projects must be standardized.Thirdly,qualification management must be improved.Fourthly,the danger reminder mechanism of high-risk tourism projects must be improved.Fifth,emergency rescue mechanism must be improved.Sixth,high-risk tourism insurance mechanism must be improved.Seventh,legal liability mechanism must be improved.
