Discussion On The Reform Of Specified-Number-of-Prosecutor

With the implementation of procuratorial reform,a reform called specified-number-ofprosecutor,as its important,is also gradually advancing.The implementation of the the system called specified-number-of-prosecutor,conforms to the laws of justice,as well as it is conducive to the realization of prosecutors' professionalization,and to improve the quality and level of China's procuratorial work.In the perspective of comparative study,with the procuratorial system of Taiwan mentioned as the guide,this paper mainly studies the establishment of the system of specified-number-of-prosecutor,and its various aspects of the prosecutor management,hoping to give some advice for the establishment and improvement of the system.The essay is divided into four parts.The first part,the analysis of the reasons for the establishment of the system called specified-number-of-prosecutor.Currently,there are many shortcomings in the group of prosecutors,which restricts the level of China's procuratorial work to improve.Meanwhile,dealing with the relationship between prosecutorial independence and procuratorial integration asks us to carry out the system of specified-number-of-prosecutor.The second part,the establishment of the system.The essay talks about how to reasonably determine the proportion of the public prosecutor,according to the present situation of prosecutors and the procuratorial work,which can make sure the setting up of the system meaningful.Using Taiwan prosecutor selection system for reference,the essay explores how to select existing prosecutors into the port,improve the judicial examination system,enhance the accumulation of experience in handling cases,and set up Selection Committee of the prosecutor.By adopting this multipronged strategy,we can establish a perfect election system,and strictly select outstanding prosecutors into the post to exercise procuratorial authority.The third part,practice the classified management of procuratorial personnel,divide the procuratorial personnel into three parts: prosecutors,procurator assistant attorney,and administrative staff.For different categories of prosecutors,implement distinguishing management.The forth part,the responsibility of prosecutor system.Based on the principle of "power comes with responsibility",when we give prosecutors relatively independence of the specific permissions,we should set up the responsibility of prosecutor system at the same time,and improve the case handling organization of the procuratorial organs,clarify responsibilities and authority of procuratorial personnel in the form of Power list,Responsibility list,and Negative list,improve the supervision mechanism and accountability mechanism,so as to make the operation of prosecutorial authority more standardized.
