From the current situation of child welfare in our country, our children’s welfare work lacks theconcept of "children benefit maximization";Laws and regulations related to the child welfare policy andmessy, scattered, lack of independent system of child welfare legal system, not a special "children’s welfarelaw";Did not form a complete set of special child welfare security system and the child welfareagencies;The existing child settlement measures are not perfect;Child welfare work problems such as lackof multiple participation channels.In the field of law research, child welfare security system is to safeguardthe rights of children as a starting point, combining with the field of child welfare in our country legalissues and practical problems, put forward specific legal advice to protect the rights of children, children’sinterests.So on from the perspective of jurisprudence and study the theoretical basis and legal value behindthe children’s welfare, to probe into the legal protection of child welfare in China development on childprotection, social stability and national future development has important practical significance.This article starts from the concept of children, child welfare and child welfare objects, the rights ofthe child the concept as the starting point, and then leads to the relationship between the child welfare andchild protection, after discussing the theoretical basis and legal value of protection of child welfare law,basic principles and around the children’s welfare protection to children’s welfare in the clear positioningthe child protection system. The second part of this paper introduces the present situation of the firstChina’s child welfare policy and law framework and child welfare administration, to found the childwelfare in China and the reasons behind. Finally the third part proposed the concrete suggestions toimprove China’s child welfare system from the angle of law, and learn from foreign experience in thedevelopment of children’s welfare, is to establish the "best interests of the child" concept, in the form oflegislation to scientifically determine the needs of growing children, countries to undertake comprehensivechild protection duties, reasonable and comprehensive allocation of family, social, national many resources,from the right to arrange, children’s welfare institutions to implement the system based on the establishmentof a comprehensive system to protect children’s welfare system, all-round and multi angle to meet the needsof growing children, to ensure that children’s physical and mental health and happy growth. At present, China’s child welfare law development direction is a complete system of special Child welfare lawpromulgated.
