Study On Marine Legal System Of United States

Ocean has been more and more important within international scope.For coastal states,ocean has great significance in military,economy,and science development.United States'geographic character of three sides of whose land is surrounded by the sea determines the attention paid to the marine development.The comprehensive marine legislation of United States due to the marine developing history which the sea power was regarded as an important issue and the prior development and utilization of natural resources in the sea.United States has been making and enacting statues of all aspects of marine around the national marine strategy.In international scope,under the United Nations Convention of Law of the Sea(UNCLOS),United States maintains the national sea interests by treaties and agreements,as well as by choosing the application of UNCLOS.Domestically,United States has been established marine and coastal management system,strong sea power,marine environment and eco protection mechanism by marine legislation.Thereby,completely marine legal system has been formed.In this paper,the author firstly tried to discuss the marine legal system of United States in a macroscopic view in the earliest chapter.In the second chapter,the outer environment which the legal system formed in was discussed,including the U.S.coastal geographical conditions,the people's awareness of ocean and the review of U.S.marine economy.Chapter three is about the legal branches in the marine legal system.First of all,legislation of U.S.marine rights and interests had been listed,including treaties,agreements and the administrative orders which has law force.Marine strategy under the interest orientation of United States had also been analyzed.After that comes the shipping legislation and how it affected the Chinese shipping legislation.Then the legislation with respect to domestic developing and utilizing had been researching in the legislative substance,the main contents and the form.In the last chapter,inspiring and learning has been taken in the terms of completing Chinese marine legal system in terms of legislative concepts,forms and substances.
