Legal Research To Promote The Development Of Marine Economy In Our Country

It is emphasized in our 13th Five-Year Plan that we should actively develop the marine economy, stick to taking into consideration both the development of sea and land, scientifically exploit marine resource, protect the marine environment, safeguard marine right and interests, and build China into a marine economic power.The development of marine economy has been an important component of China’s economy. And there have to be the force of law behind it. While, all kinds of policies, laws and regulations, which are to promote the development of marine economy by China’s central and local governments are incomplete and not unified. What’s more, we are lack of an effective and coordinated integrated marine management system. In addition, It is a decentralization and turf-conscious management system for our development of marine economy, which lead to low management efficiency.Therefore, building up a comprehensive and unified marine law system, integrating the existing and fragmented marine management departments, and building up efficient marine management system would be of far-reaching significance to promote sustainable development of marine economy.This thesis consists of four parts,namely:The first part discusses the concept of domestic and foreign scholars on the definition of marine economy, marine economy summed legal connotation, and from the three aspects of the legal property of marine economy, marine economy to further explore the specific legal promote value.The second part outside the national marine economic development practices, for example, South Korea, Japan, Australia and Canada, represented by the marine management system of each country, the development of marine-related economic laws and regulations and relevant practices departure, in-depth study of the development of extra-regional countries the successful experience of the marine economy, summed up the series can learn from the development of China’s marine economy.The third part describes the status of the legal system of China’s marine economy development, starting from our practice of the development of marine economy, the main approach of research and development of marine economy of the existing laws and regulations and regulatory documents, summed up China’s development of marine economy the main legal problems existing in the process.The fourth part is the development of China’s marine economy legal recommendations for improvement, improvements proposed five measures, including the establishment of soundlaws and regulations to promote the development of marine economy, strengthen and improve the administrative system of marine law enforcement, the establishment of the legal system to protect the base construction management, the creation of marine resources tenure system and management mechanism and strengthening of marine environmental protection and ensure the sustainable development of marine economy, further promote the sustainable development of marine science economy.
