Study On The Liability Of The Government In The Food Safety Supervision

Food safety has become one of the most popular topics of modern society.Food-incurred events have caused severe impact to the society every year,so that food safety has become the focus of attention which the human beings should pay.With the growing development of materials,China's food supply has experienced from insufficiency,to saturation,until the request of desirable diet which is necessary for mankind.However,there are countless food safety-related issues in China.Safety events incurred wherefrom have been disclosed by news frequently,giving rise to new awareness of food safety crisis among the Chinese citizens who are the customers.Therefore,the government shoulders inescapable responsibilities for the supervision of food safety.After the Chinese market economy has replaced the planned economy,China's food law supervision and management system in the past can no longer adapt to the present development.As a result,strengthening government responsibility is of top priority in the process of solving problems on food safety.Besides,food safety issues also give prominence to the inadequate and ineffective supervision of the Chinese government and relevant departments which are responsible for food issues.This paper proceeds from the government responsibilities for food safety supervision and briefs the related conditions in this connection.The following issues have been set forth in detail.The first part of the paper gives a detailed exposition of China's food safety,the status quo of food safety and the necessity of government responsibilities for food safety supervision.The second part focuses on the recent developments and related issues of China's food safety supervision model and analyzes the legislation of China's related food safety.The Food Hygiene Law as approved and promulgated in 2009 laid a foundation for the food safety-related legal system focusing on this law.Against this backdrop,there are roughly 800 documents in China concerning the laws,regulations,judicial interpretations related to safety management as well as normative documents.All these have basically put into place a food safety legal system compatible with China's national situation which is an obvious and inevitable factor when solving the problems on food safety.But as food safety supervision is a complex and systematic project,presently model is available for China's food safety supervision system which brings about tremendous improvement and progress in terms of the object of supervision,laws and system,and technical method.Compared with some foreign countries,China still has many defects in this respect,which is mainly embodied in the administrative legislation,law enforcement supervision and administrative accountability in the supervision processes.The author goes on to analyze the reasons for such kind of phenomenon on food safety.The unclear powers and responsibilities of related administrative departments,the management of multiple aspects,the marked issues born of overlapped management and loopholes,the inadequate basis for government management and other issues have become the main factors incurred during China's food safety supervision.Generally,China's food safety issues come down to the government's lower level in its supervision of food safety and to the depressing supervision results that disappoint the food customers.The third part targets at China's manifestations in its present food safety,China needs to carry out formal discussion,try to formulate food safety-related laws,regulations and constitutions as soon as possible,strengthen government responsibilities for legislation and law enforcement,formulate complete food safety laws,regulatory system,and improve the administrative supervision mechanism and the safety standard system.Meanwhile,the government accountability mechanism should be constructed during food safety supervision.Food safety issue must be faced with by each responsible government.Therefore,government responsibility system for food safety needs to be established and improved in order to ensure food safety and supervise the government's fulfillment of duties which should be paid great attention to effectively.It is hoped that the analysis and discussion of issues related to China's food safety supervision will be conducive to issues regarding the supervision of food safety.As China's national economy is flourishing,how to treat food safety in a scientific and safe way has been a major issue concerned and dealt with by the Chinese people.By analyzing of the importance and enforceability of food safety supervision and other aspects,this paper suggests the improvement of the government and related competent organizations in terms of China's food safety issues by means of accountability system,which is directed at administering the methods for handling China's food safety issues effectively.
