The Causes And Countermeasures Of Inefficiency Of Law Enforcement

Efficiency is the important goal and guiding ideology of public administration. For administration departments, efficiency principle of law enforcement means that in the prerequisite of administration according to law, administration departments should maximize the benefits in lowering costs in order to maximize the benefits of law enforcement when organizing and managing the society. Police department is one of the important sections in government, while local police station is the grass- root institution of police department in China. As the grass-root institution, local police station should be responsible for executing every task in police department. In recent years, the efficiency of law enforcement in grass-root police obtains high attention. The consequences of low efficiency in law enforcement, that the internal resource frictions, increasing management difficulties and conflicts between police and citizens have become more and more serious. Therefore, to study the cause of low efficiency in law enforcement in depth and to offer advice to solve this problem is the key subject to improve the managing efficiency in local police station.Considering the actual situation in CL local police station where the author works and the public administration theory the author master, applying historical data analysis method,data comparison analysis method and empirical analysis method this paper will deeply analyze why the efficiency of law enforcement is low in local police station and will propose corresponding advice and countermeasures.This article is divided into five parts, the first part is the background of the problem of low efficiency of local police law enforcement, and the problem has its special social background. The influence due to the evolution of the various social contradictions caused by the problem of low efficiency of law enforcement is more serious, and the monographs and papers studying the current basic law enforcement are not comprehensive enough in reference to law enforcement difficult issue. This part mainly analyzes the necessity of discussing the low efficiency of grassroots police law enforcement. The second part analyze the importance of grassroots police law enforcement efficiency, beginning with the functions of the public security organs and police stations, combined with the requirements of relevant laws and regulations on the law enforcement efficiency. The third part talks about the historical development and current situation of the CL police station the author works in, from the historical data analysis finds various factors influencing the grassroots police law enforcement efficiency. The fourth part focuses on the major risk factors for negative impact on law enforcement efficiency. First, institutional factors, operable defects existing in laws including the "criminal law", "public security management punishment law, “the people's police law”. Second, judicial principle and process factors, when applying “control trial separation principle”, “administrative penalty discretion”, "innocent until proved guilty" in practical operation process, it has negative effects in improving law enforcement efficiency. Third, the communication and coordination means is cumbersome and the channel is not unblocked between the superior and inferior of an institution and between different institutions, which has negative effect to the law enforcement efficiency. Finally, the executor's own factors have negative influence on law enforcement efficiency. These several factors, from macro to micro, from outside to inside, allow us to give comprehensive analysis on the problem of low efficiency of law enforcement synthetically and in depth. The fifth part puts forward the idea and scheme. The author puts forward corresponding solutions according to the existing problems raised in the fourth part.Ideas and solutions are put forward by basing on the reality, comparative analysis, combining theory. The author hopes the law enforcement of local police becomes more efficient and more operable, in order to achieve the original purpose of this study.
