China is a major country and also the one of most important developing countries in the world.This self-identityis related to the our country's positions in the international society and our developing statement,on the one hand,it influence our country involved in the birth of the United Nations convention on the law of the sea,on the other hand also brought some problems in safeguard our maritime rights and interests.In this process,we got both the successful practice and failed regret the lesson.Based on China's participation in United Nations conference on the third law of the sea as a starting point,analyzes the factors in the developing stage and international situation,our own national identity may be defined as developing countries in the 1970 s.During the third UN conference on the law of the sea,developing countries have played a constructive role,has essentially by rights,a final vote in the law of the sea.China can be said to be negotiating play to the advantage of developing national identity in the process of a successful practice.But we should also see that the UNCLOS profoundly affected the countries to the maintenance of maritime rights and interests of oneself,also fully noticed the landlocked countries such as the geographical disadvantage of maritime rights and interests.Our country face to more and more maritime disputes with the country far from our country or our neighboring country.On the one hand,this is because in the 1970 s of the older negotiator with national policy makers in China cannot anticipate after the rapid development of economy in our country,to stand in the Angle of the hour or by developing countries the need of internal unity,not fully express our country and the developing countries in the aspect of maritime rights and interests maintenance some part is not consistent.In addition,China and western countries in the marine rights and other common interests is a widening trend of development,the struggle and the cooperation will coexist from a view of long runThe rise of China is faced with the much-hyped "China Threaten" in the developed countries,there are also developing countries over whether China will become a "new colonialism" on behalf of the question.Proposed in our country has strong charisma of The five principles of peaceful coexistence have in the past 60 years,UNCLOS after it was signed by never to large-scale revision,only in the 90 s of last century has pased Resolution on the Agreement relating to the implementation of Part ? of the United Nations Convention on the Law of the Sea of 10 December 1982 about undersea resources development.From the point of moment,how to deal with the 21st century between our country and developing country in the aspect of maritime rights and interests maintenance,how to balance the rise of China's moral authority with the actual national interest is the use of international law and service of the country's decision-making in many ways a promising land.This article selects the maritime rights and interests in the national interest as the research object,analyses the status of China's maritime rights and interests maintenance in developing countries.With the improvement of comprehensive national strength,how new national identity in a responsible country involved under the UNCLOS,is one of the pressing problems we are facing in the process of development.During this paper,we combed the third UN conference on the law of the sea,adhere to the developing countries and to get the final through some practices of Chinese identity brought some positive effect in order to maintain our maritime rights.In addition,this paper also analysis to our country in developing countries claim may adversely affect some of the interests as a result of China's special geography location.The last part,based on the transformation of national identity in our country,to the new situation of maritime rights and interests maintenance some suggestions are put forward.
