A Study On The Construction Of The System Of Local Government Power List In China

With the deepening of the reform of China's government system and mechanism,the local government at all levels is continuing to change the role from the functional government to the service-oriented government.This situation demands the restraint of the power and put the pubic power in the framework of the system to avoid the occurrence of government ultra vires.At the same time,the government could provide more qualified public goods and services to the society under that framework.The implementation of the local government power list system conforms to the trend of government reform,which maybe avoids the improper action of the government.However,as a new policy practice,the power list mechanism presents some problems during its developing process that we should admit and solve it.Otherwise,this practice may fail without any profit for the society.By outlining the background information and the significance of the power list mechanism,this thesis summarizes the definition of power list mechanism,the related theories and principles of the power list mechanism.In view of the fact that the list of local government powers in China is too complicated,the list of powers published by the environmental protection departments of the three levels of local governments in Shandong Province,cities and township(urban neighborhood)is selected as the analysis template.On the basis of case analysis,this thesis makes a conclusion of experiences for the practice of the power list mechanism.After careful combing and summarizing,it reveals four institutional problems that exist in the construction process of the power list system:the first one is the legal system,the limitation and the coordination problem in the procedural mechanism;the second is the vertical existence in the structural mechanism;the third is the authorization and supervision of power in the checks and balances mechanism;and the forth is the error correction mechanism.With the above analysis,this thesis makes some suggestions for the improvement of the power list mechanism in our country.Firstly,improving the legal procedures to strengthen the legal process of the parties involved in the mechanism;improving the dynamic mechanism to strengthen the timeliness Long-term updating of the procedural mechanism;perfect the review mechanism,strengthen the unified guidance of the coordination mechanism,and realize the procedural justice of the power list system.Secondly,improving the vertical structure,to establish the level of equal rights between the level of mechanism;improve the horizontal structure,the establishment of inter-departmental responsibilities and other mechanisms to achieve the power list system of power structure of the scientific division.Thirdly,clearing the power of ownership,regulating the discretion of administrative discretion;the establishment of internal and external power of the multi-supervisory system,to achieve power in the system of effective checks and balances.Fourthly,improve the power list feedback mechanism to enhance public participation,enhance the rationality and scientific nature of public power;improve the power list of administrative relief mechanism to protect the rights of citizens,to achieve power in the system of timely correction of power.The last part of the thesis makes an overview of the whole text and proposes the potential research in the future.
