Research On Legal Issues Of Follow-up Supervision Of The Administrative Licensing

In recent years,our government has made a series of achievements in the field of transformation of functions and simple regime,but there is still a definite gap with the expectations of the masses and the requirements of economic and social development.The Administrative Licensing Law of the People's Republic of China failed to change the status of the absence of follow-up supervision of the administrative licensing.Project approval belongs to administrative licensing must conform to the Administrative Licensing Law of the People's Republic of China.In practice,the absence of follow-up supervision of the project approval directly leads to incidents occur frequently which is endangering economic security,social security or ecological security.The purposes of the project approval are not effectively realized to remedy market failures,rationalize the distribution of resources,optimize the industrial structure and preserve the ecological environment.Accordingly,doing research on follow-up supervision of the administrative licensing,particularly follow-up supervision of approved industrial projects indeed has profound theoretical merit and practical significance in maintaining the interests of citizens,legal persons and other organizations,and promoting the construction of a government ruled by law.The author tries to summarize the status quo of the follow-up supervision of administrative licensing of our country.Besides,the author expounds the problems of follow-up supervision of the administrative licensing,for instance,the relevant laws and regulations are imperfect,the legal literacy of supervision personnel is not high,the approaches of follow-up supervision are single,the guarantee system for follow-up supervision is not sound,the responsibility system of follow-up supervision is not reasonable,and the statutory responsibility of licensees is soft.In the end,the author provides follow-up supervision of the administrative licensing with basis for law enforcement and procedural norms from legislative angle,summarizes follow-up supervision of the administrative licensing from an institutional aspect,and provides reference opinions to improve follow-up supervision of the administrative licensing,from the perspective of follow-up supervision of approved industrial projects.
