In the 21 st century,China develops to a rather fast stage in all areas.While,with the economy grows rapidly,the population of elderly increases rapidly as well.Facing the fact that China enters into the aging society,the traditional maintenance and guardianship system has been unable to cope with a series of problems caused by 4-2-1 family structure and empty nests.The rights and interests of the majority of elder people are under a blank of legislative protection circumstances.Therefore,the concept of community tendence hopes to suit the supporting system of China.This essay is based on the concept of China's community tendence,values and its system design.In order to establish Chinese characteristics tendence system,we need to discuss to achieve the reference and organic bond of British community care system and Germany tending system through this system.Compared to British community care system and Germany tending system,they all have their pros and cons.The British community care system is based on achieving the goal for the elderly,but neglecting their autonomy capacities.And the Germany tending system fully respects elderly's autonomy.While under the present social background,we lack of the carrier of achieving the system.If we copy them mechanically,the system inevitably couldn't suit our national situation.In order to set up our own community tendence,we need to learn from British community care system,and combine with Germany tending system on respecting elder people's awareness and take full advantages of our supporting community.Discuss to design tendence system based on community,thus finding a way on solving supporting problems of elder people.This essay has a system design on China's community tendency system by using the value theoretical analysis and comparative analysis.Firstly,using conceptual analysis to summarize the concept of community tendency.Secondly,using value analysis method to discuss the shortages of the current system.Then,in order to put forward the effective information for reference,the writer takes comparative and literature analysis method into use to analyze the successful experiences of foreign legislation.Last but not the least,through this essay's research,the writer expect to enrich the content of the relevant theory,consummate theancillary system,and protect the elder people's legitimate rights and interests in the true sense.
