Mediation has a long history in our country.China ancient society is an isomorphic social discipline,law is not only the supplement of the legal system,but also an important means to resolve conflicts and maintain linlixiangqin grass-roots social stability.In resolving the social disputes,Chinese traditional society advocates"no litigation",that is,to resolve disputes through private mediation rather than judicial means.If we want to promote the "no dispute" dispute resolution method,and also successfully resolve disputes,and achieve the purpose of maintaining social stability,we need a "middle way" means to achieve.The wisdom of the Chinese people has created and derived a social mediation system known as the "Oriental flower".With the rapid development of urbanization and modernization in China after the reform and opening to the outside world,moral confusion and spiritual confusion have emerged,and social problems have become increasingly frequent.The importance and urgency of social mediation are becoming increasingly prominent.The People's Mediation Law of the People's Republic of China promulgated and put into effect in 2011 has stipulated all aspects of the people's mediation,and has effectively safeguarded the authority of the people's mediation from the legal level of the people's mediation of People's Republic of China.People's mediation has the advantages of lower cost,less harm to health,and saving social resources.Social mediation evolved from the people's mediation,but it still differs from the people's mediation.Social mediation not only can effectively solve the problem,but also from the source to check erroneous ideas at the outset to eliminate hidden dangers,to avoid problems.Promulgated and implemented in the "People's Republic of China people's Mediation Law" after two years,Hefei Binhu City Baohe District century community-the first street level community approved the establishment of the Hefei municipal government was founded.Through a series of related to the comprehensive management of community construction and community,Binhu century has made remarkable achievements in development,has won the national civilized unit,the country's most beautiful volunteer service to the community,Chinese Social Innovation Award and other national and provincial honors more than 30 items,formed a unique "Hefei century model",in which social mediation system play an important and constructive role.This thesis takes the Binhu century community in Hefei as the research field,and has worked as an intern for nearly 8 months in Binhu community work department.Let the author have the opportunity to make a thorough investigation into the social mediation mechanism in this community.In the research process,the author visited the community work of Party committee,in charge of the comprehensive management of community public work department minister,community comprehensive management office director,community justice office staff and accepted the mediation of community residents,collect a lot of valuable interviews and survey data.After consulting a number of literature,in-depth research and found that Binhu century community in the innovation of social governance in the process of social mediation success experience for reference,mainly:first,focus on construction,the formation of "mediation" pattern.Two,pay attention to the overall quality and professionalism of the mediation staff.Three,pay attention to the construction of civil mediation team,mobilize residents to participate in mediation enthusiasm.Four,pay attention to the innovation of property management mechanism.Of course,we also find the inadequacies of the mediation mechanism,mainly in the following aspects:first,the community residents lack understanding of social mediation.Two,the mediation agreement lacks the enforcement effect.And puts forward the corresponding countermeasures and suggestions are as follows:first,strengthen the social mediation related content propaganda.Two,strengthen the"acquaintance plan" to promote efforts to create a good social atmosphere.Three,strengthen contact with the grassroots courts and create a good atmosphere for the community.Three,strengthen contact with the courts at the grass-roots level and promote the judicial confirmation of the mediation agreement.Four,pay attention to the standardization of the language of the social mediation agreement.
