Research On The Legal Issues Of Overseas Pursuit Evasion From The Perspective Of Anti-corruption

The fleeing abroad of corrupt officials has become a major obstacle to the smooth progress of anti-corruption efforts,how to hunt down corrupt officials successfully and to accept Chinese legal sanctions has become a hot topic of scholars at present.Although China has made considerable progress in pursuit of corrupt officials outside in recent years,the current situation of China’s overseas pursuit is still not optimistic.This paper will be divided into four parts.The first part is an overview of Overseas Pursuit Evasion.Pointing out the basic concept and characteristics of the overseas pursuit,the historical evolution and the current situation of China’s anti-corruption overseas pursuit.Overseas pursuit in our country has made certain achievements,but compared with the official running away,the recovery of the staff is only the tip of the iceberg.Therefore,China will continue to intensify the pursuing efforts to strengthen international cooperation against corruption and improve China’s position in the international anti-corruption.The Fourth Plenary Session of the Eighteenth Central Committee of the Party emphasized the need to intensify the pursuit of stolen money or goods,and extradition repatriation efforts.The second part presents the object of overseas pursuit.The object of overseas pursuit includes people and things,hunting return flight officials to accept the legal sanctions is the ultimate goal of our pursuit abroad.Corrupt officials fled with money brings a terrible hazard to economic,political,social and other aspects,for the smooth work of the pursuit,we should be clear about the characteristics of the flight personnel.Being Clear about the characteristics of fugitive personnel and its whereabouts is conducive to the smooth development of our overseas pursuit work.The recovery of corruption assets transferred abroad will help to disintegrate the economic base of the flight officials,so that the overseas pursuit can work smoothly.The third part mainly introduces the way of pursuing overseas.Extradition is undoubtedly the most important way to recover the fled officials,but from the extradition principle and the quality and quantity of extradition treaty,there are some difficulties in the use of fugitives extradition in China.This paper puts forward the solution to the problems in the extradition,and actively uses the alternative measures of extradition to play its role in the pursuit of overseas operations,and takes a multi-pronged pursuit strategy for the flight of officials.The fourth part mainly explains the legal improvement suggestions to the overseas pursuit.At present,the provisions of China’s "extradition law" exists inconsistent things with the "United Nations Convention against Corruption".We need to revise the"Extradition Law" further,and make it further integration with the "United Nations Convention against Corruption." Persuasion plays a great role in the pursuit,and it also has the characteristics of procedural weakening,but our law has no clear provisions for persuasion,Chinese judiciary should issue the legal provisions and judicial interpretation on the persuasion as soon as possible,when there will be a clear basis for the judiciary and government agencies to use in the overseas pursuit.By making reasonable asset share system,promote the overseas pursuit smoothly.
