Illegal kindergartens are breeding in a long time,the reports also emerge in endlessly,but few people analysis their harm from the aspect of law,first of all,defining the illegal kindergartens from the goal of early childhood education,standards,and the meaning of governance illegal kindergarten in this paper.And thinking illegal kindergarten is a civilian public organization that is unable to meet the early childhood education policy of promoting the physical and mental health of children and is not good for the right of children to education,even can damage the life and health.By analyzing the present situation and problem of Illegal kindergartens,analyzing cause in law that why are existing continuously.And the cause of law is including that the kindergarten's legal consciousness is not strong,administrative licensing procedures is complicated,administrative organs lack of administrative omission and administrative penalties,imperfect legal norms concerning infants' education policy,less policy support for early childhood education.Secondly this paper argues that we should put the infants' interests firstly in the process of governance illegal kindergartens,and we should follow Children Benefit Maximization Principle and the principle of territorial government.Thinking to establish and improve the legislation of preschool education,determine the preschool education basic law,and put the two important principles in this law.Also need to strengthen the private kindergarten organizers' Education Philosophy and the rule-of-law concept to improve the attention to the infants' rights and interests of kindergarten.The governments should play a leading role in the process of governance illegal kindergartens,pay attention to the scientific planning of the kindergarten setting,should set up specialized law enforcement agencies to strengthen the kindergarten education administrative law enforcement.Also jointing social power in building children protection social supervision system.
