The Research On The Practice Of The Local Legislation Of The Cities Divided Into Districts

This is the first amendment of the Legislative Law for the past 15 years.And after the modification,all cities divided into districts get local legislative power while it's limited to three types of issues: urban and rural construction and management,environmental protection and historical and cultural protection,etc.This unclear definition has caused lots of problems both in theory and practice.So its specific content should be further defined.In this paper,author will discuss the legislative power of the district-based city and the operation of the power,and give targeted recommendations through the summary of the practice of the local legislation.This paper is divided into four parts: firstly clarifies the background of the legislative power of the city;secondly sorts out the practice of the locallegislation;thirdly on the basis of summarizing the exercise of the local legislation,clarifies the problems existing in the local legislation of the districts and analyzes the causes of the problems;lastly puts forward some advice on improving the exercise of the legislative power,including improving the local legislative mechanism to improve the local legislative capacity,expanding its scope of authority appropriately and changing the concept of legislation thus to ensure the realization of the original intention that central power gives all cities the local legislative power.
