The cities with divided districts have been granted local legislative power in terms of urban and rural development and administration,environmental protection and historic and cultural protection since the Legislation Law was revised in 2005.The local legislative institutes tend to misunderstand the scope of legislation as abstractly description of the scope of legislative power.Less discussion in the scope of historic and culture protection theoretically and practically,compared with in-depth debate in that of urban and rural development and administration.Whether no argument over the scope of historic and culture protection or the focus of local legislation having not pay attention to it,that is a question worthy to be research.Firstly,the article defines the scope of legislative power of historic and culture protection by the Law and the paraphrases of the law committee of the National People’s Congress Standing Committee.Secondly,it explains the meanings of historic and culture protection lexically and academically,as no description in the law and any paraphrase.Thirdly,it presents the local legislative institutes’ mode to comprehend and understand the scope of historic and culture protection,via analysis on the regulations legislated by local institutes on it.It is variable in local legislation on the scope of historic and culture protection.The local legislative modes have not yet broken the scope,as the spectrum of lexis is wide.Some creative regulations emerge,satisfying the purpose of local legislative power.However,duplication and breach of superior laws and regulations and less characteristic legislation still existence,especially in the regulations of general affairs.Furthermore,the local legislative practice also could provide experience to the central legislative institutes to deal with the general affairs in terms of uniformed legislation.
