Since twenty-first Century,the Chinese government has made remarkable achievements in poverty reduction.China's rural poor population from 94 million 220 thousand in 2000,reduced to the end of 2016,the number of people,poverty standards increased from $865 per year to $3000 per year by 40 million.As the first developing country to realize the halving of the poverty of the United Nations Millennium Declaration,China has made great contributions to the cause of poverty reduction in the world.China's poverty reduction achieved no doubt,but at the same time,the poverty reduction target recognition is not accurate,and the object of national poverty range is not clear enough,and lack of effective identification of poverty poverty assessment standard and the management of the funds and use problems,which reflects the poverty alleviation in China still faces enormous challenges.Therefore,in-depth research on the legal system of the theory of poverty,poverty alleviation and legislation is particularly important.This paper through the research on the theoretical basis of the existing legal system of poverty alleviation,into some poor villages on-the-spot investigation and statistical data to reference the National Bureau of statistics and the People's Republic of China audit,legal problems of China's poverty alleviation work are analyzed,and puts forward the corresponding countermeasures to improve the legal system in China Poverty alleviation.This paper is divided into five parts:The first part is the overview of the legislation for the poverty alleviation law.According to the The connotation and denotation of poverty and poverty alleviation law,this part proposed legislation for the poverty alleviation law,it not only analyzed the arrtibution of the poverty alleviation law,but also made a comparison to the Social Assistance Law and the Charity Law.The second part analyzed necessity and feasibility of the legislation for the poverty alleviation law in our country.The third part analyzed the problem of the poverty alleviation law by summarising the poverty alleviation law in our country and the field investigation.The forth.part introduced the legislation for the poverty alleviation law of America and Japan,it analyzed the legislation experence of these two countries and hope that can be as a reference.The last part of this essay made some suggestions of the legislation for the poverty alleviation law.This essay tried to clarify the poverty alleviation's principal part and its responsibility,the objects for poverty alleviation and its recognized standards,the rights and obligations of the poverty alleviation objects.And made some useful suggestions of establishing the social subjects supervisory mechanism for poverty alleviation,and consummate China's poverty alleviation funds law regulation.I hope that this essay can make some help for consummating top design of poverty alleviation system in our country.
