Situation And Measurement Of Building Social Security System For The New Generation Of Migrant Workers On The View Of Managing State Affairs According To Law

Fully implementing “Managing State Affairs According to Law” has been the main concern of the communist party since the 4th plenary session of the 18 th CPC Central Committee.With the concept of rule of law continuously recognized by more people,China has embraced a new chapter of ruling society by law.Under this background,migrant workers of the new generation has gained more solid and sound support for their social security.At present,there are many deficiencies in the existing laws and regulations concerning the social security of migrant workers of the new generation.For instances,overall planning is lacked in legislation and the system is incomplete;the level of legislation lacks of authorities and public credibility;legislation development is unbalanced;fairness of legislation can hardly manifest to the public.There are also some drawbacks in law enforcement such as weak abidance to the principle of law enforcement,enforcing law at will,low managing standard of administrative law enforcement,bad image of law enforcement and lack of profession.In judicial,there are still some problems like errors of judicial concepts in judicial civil servants,unstandardized judicial practices which makes the social security of migrants of the new generation hard to be protected.Besides,the weak awareness of rule of law in the social security of migrant of the new generation is one of the main reason for the problems occurred in social security.The above factors in rule of law cause huge difficulty in connecting the social security of migrant workers of the new generation and the general goal of managing station according to law.Therefore,scientific legislation systemshould be established on the base of China's actual state conditions.For instance,multi-layer law regulations should be established to protect the new generation migrant workers' social security.Strict law enforcement should be implemented.For instance,enforcement powers should be exercised legally to prohibit abuse of rights,and the concept of advanced law enforcement should established.Law enforcement means should be improved.The judicial of social security of the new generation must be independent and fair.For example,trial must be neutral and the trial process must strict and regulate.The mode of labor arbitration can be replaced by “freedom of trail” system.As to migrant workers of the new generation,they must be improve their awareness of law.For instance,enterprises can conduct law education to the new generation migrant workers,which makes them recognize and know how to use laws and seek for social treatment they are supposed to have.In addition,long-term supervision system on social security of the new generation migrant workers should be established to ensure that the social security of the new generation migrant workers work smoothly.
