Studies On Legal Institutions Of The Food Safety Risk Assessment

Food safety accidents occur frequently in recent years. So there is a crisis of confidence in the field of food safety. Food safety problems occur again and again and come into the public view after the media exposure of China's "Sudan Red One"incident since 2005; such as "melamine milk powder" incident in 2008; "lean" event in 2011 and " poisoning rice " incident in 2013 etc. These food safety issues related to public interest; the health of the people and the country's long-term stability, so the development of a set of comprehensive food safety legal norms system is necessary and the government should pay attention to it. However, our country has been dealing with food safety issues afterwards for a long time and lacking of pre-prevent system which leads to the problem of food safety. In order to change the passive situation,with "KFC Red Sod" as the trigger point, food safety risk assessment mechanism began to receive great attention. In 2009, government promulgated the Food Safety Law of the People's Republic of China, and raised the food safety risk assessment mechanism to a legal level. By the study of the legal issues of food safety risk assessment, it is possible to scientifically evaluate the risk of food safety before the problem actually occurs, so as to achieve the purpose of preventing the occurrence of risks.This article is based on the analysis of the newly revised Food Safety Law of China and its related legal systems on October 1, 2015, found that there are still many problems in the legal system of food safety of food safety risk assessment. According to the legislation and risk of food safety risk assessment in the developed countries such as EU, USA and Japan, found that it is necessary and feasible to solve problems in the field of food safety by studying the advanced and mature legal system of food safety risk assessment in foreign countries; and by drawing on the advantages of it;First, we can improve the governance structure of food safety risk assessment organizations by strengthening the independence of food safety risk assessment agencies, ensuring the authority of institutions and clarifying the responsibilities of institutions. Second, perfecting the program of food safety through the initiation procedure of China's food safety risk assessment;Third, the selection system of scientific advisors can be improved through the selection of scientific consultants'experts. Perfecting the open and transparent system of expert behavior; setting up the expert accountability system and formulating an independent external peer review system to perfect China's food safety risk assessment expert system. Fourthly, public participation can be ensured through broadening public participation risk assessment channels and ensuring public participation incentive mechanism.
