Research On Access Of EU Genetically Modified Foods

In recent years, with the rapid development of transgenic technologies, the commercial usage of genetically modified foods become increasingly widespread, which outlines a new picture for the development of human civilization. However, the genetically modified foods, due to the risk uncertainty, have been controversial on safety issues. Various countries have taken necessary regulatory measures on genetically modified foods to protect human health and environmental safety, which focus on the access system. The European Union, as one of the regions with the strictest barriers in the world food market, adopts strict legal regulation on the access of genetically modified food under the guidance of the precautionary principle. At the same time, the approach based on science standards is in line with obligations under WTO, which makes it difficult for other countries to criticize. Studying EU GM food access system has great theoretical and practical significance in improving our food safety legislation and promoting transgenic technologies. Therefore, this paper will carry out analysis on a series of problems involved in the EU genetically modified foods access system.The paper contains about 30,000 words, which can be divided into four parts in addition to the introduction and conclusion.Part I: Analysis on background of legal regulation of genetically modified food. This part first combs the definition of genetically modified food and commercialization development and carries out analysis on the necessity for genetically modified food regulation under the circumstances of undefined genetically modified food risks. It is precisely in the contradiction between the flourishing development of transgenic biotechnologies and uncertain safety of genetically modified foods that the EU takes law regulation on the access system of genetically modified foods in order to restraint unsafe genetically modified foods into the European market.Part II: The EU's legal Framework of access of genetically modified foods. This part describes the background the EU's legal regulation on the access of genetically modified foods, and through combing the EU's institutional evolution in terms of access of genetically modified foods, analyzes the constitution of EU's legal system on the access of genetically modified foods.Part III: Analysis on specific system of EU genetically modified food access. This part first analyzes the restrictive regulatory model of EU genetically modified food access, carries out detailed analysis of the enforcement mechanism of EU genetically modified foods access as well as system analysis from three aspects of the EU and Member States' regulatory agencies, risk assessment mechanisms and market approval system and explores the existing problems in detail. On this basis, the author, in combination with the problems and future development trend of the current EU genetically modified food access, evaluates the specific systems of EU genetically modified food access.Part IV: The revelation of EU's genetically modified food access system on China. This part first introduces the legislative status of Chinese genetically modified foods and analyzes the deficiencies. Then, this part draws lessons from the successful experience of the EU's management on genetically modified food access on the basis of studying development of China's genetically modified foods to proposes a few reference opinions and suggestions to improve relevant legislation of our country and promote effective regulation of genetically modified foods.
