A Study On The Duty Crime In The Beibu Gulf Economic Zone

Beibu Gulf Economic Zone is the development of new China's western border and coastal areas of national economic zone,Nanning,the capital of Guangxi Zhuang Autonomous Region and three coastal city of Qinzhou,Beihai,Fangcheng area covers,and the border with Vietnam Chongzuo and adjacent to Guangdong,Yulin City transportation,logistics merged together.January 2008,the State Council will be incorporated into the national development plan.Since then,the development of the Beibu Gulf Economic Zone into the right track,and the rapid rise of the rapid pace.In 2013,33.5%of Guangxi accounts for Economic Zone(North and south,chin,anti city)GDP 4817.43_yi billion yuan,2014,GDP rose to 5448.21_yi billion yuan,accounting for 34.8%of Guangxi.SO it has become the backbone of the economic development of Guangxi.Fair and efficient competition environment has greatly promoted the rapid development of economy,and the development of Beibu Gulf Economic Zone needs a fair and efficient competition environment.Punishing and preventing crimes is an important part of creating a fair and efficient competition environment.Firstly,this thesis discusses the general theory of duty crime,including the concept and characteristics of the crime,and analyzes the characteristics and developmentThe article mainly consists of the preface,the main body(one to four)and the concluding remarks.The introduction part mainly explains the purpose,content,method,innovation and deficiency of the article.The first part of the first part introduces the present situation of the term of duty crime in the criminal law theory,summarizes the current China' s six main academic definition of the crime in the criminal law,and one by one,the author discusses the scope of the main body of the crime,and then makes the author's own opinion and definition.Secondly,combining the concept of duty crime from the three aspects of the legal characteristics of duty crime,including the limitations of the main crime,crime and identity of the position of the unity,against the multi object.Subject the second part first to Qinzhou,Beihai,Fangcheng,for example analysis the Beibu Gulf Economic Zone over the past three years,the duty crime shows the characteristics of:A is the incidence of relative concentration of,crimes committed by prominent land acquisition,demolition,construction field;the second is bribery cases increased rapidly,and become a form of high incidence of crime by taking advantage of duty;the third is the nest Chuanan many,groups of duty crime phenomenon is obvious;the four is the large proportion of major cases,growing faster.Secondly,it analyzes the overall trend of post crime in the northern Gulf Economic Zone in the next period:the crime of corruption and bribery crime is still the main form of crime;the two is the crime situation is still serious;the three is that the crime will become more complex and subtle;four is the increase of the group crimes,and the five is the post crime and many social problems.The third part of the main body of the northern Gulf Economic Zone in the actual situation of duty crime from the objective and subjective two aspects to discuss its reasons,the main reasons of the main political and economic system is not perfect,supervision and management system is imperfect,economic reasons,historical and cultural influence,personal factors mainly have the moral quality is low,the legal system idea,the right and responsibility consciousness,distortion.In the fourth part of this paper,the author puts forward the Countermeasures of preventing the duty crime in the Beibu Gulf Economic Zone.One is to strengthen the ideological and political,legal,moral education;the two is to improve the supervision and management system.Which is divided into two parts,the first part is to improve the management system,which is the improvement of the Beibu Gulf Economic Zone of the administrative system and market management system.The second part is to improve the supervision mechanism,mainly to strengthen the authority,procuratorial,audit,political parties,social supervision,etc.Three is to improve the legal system.It mainly includes the development of the special law of the prevention of duty crime and the perfection of the criminal legislation;second,it is the strict judicial and law enforcement.In the end of this paper,the author makes a brief summary and points out and the direction of future efforts.
